Court of Appeals junks ABS-CBN complaint against Nielsen

The Court of Appeals (CA) junked a lawsuit filled by ABS-CBN Corp. against AGB Nielsen Media Research Philippines that has been alleged to tamper with its television ratings data.The media conglomerate was attempting to revive a complaint that was dismissed by the Quezon City court back in 2008, which demanded Nielsen to stop publishing its Television Audience Measure (TAM) data.Nielsen monitored the network’s ratings performance in 2007 but the partnership hit the rocks when ABS-CBN found that the company’s household panel was allegedly no longer confidential. ABS-CBN’s ratings monitoring duties was eventually handed over to Kantar Media as a result.The Quezon City court issued a certificate of finality in 2010, leading the company to seek the appellate court in hopes to revive its complaint.“Petitioner’s claim that it was deprived of due process is specious,” Associate Justice Mario Lopez said in the CA ruling, referring to the months the parties should have spent to discuss the issue as stated in their contract.“AGB Nielsen then filed a motion to dismiss, citing a provision in the contract, which provides the media research company to explain within a month any questions on validity and quality of its data,” he adds.
